On Nov.24, 1998, six months after my conviction for importing medicine from Switzerland, I was sentenced to 6 months house arrest and 18 months probation, with tests for sacred herbs. The next day, the Federal probation officer came to our house to put an electronic monitor on my ankle and encounterd a legal medical marijuana patient, Elvy Musikka, who gets US government-grown Cannabis to control her glaucoma. He insisted she had to leave and it made Elvy cry. I pointed out to him the irony of the situation and reminded him of the 9th Amendment to the Constitution, guaranteeing equal treatment under the law. Elvy stayed for Thanksgiving. Lewis, my wonderful doctor, became concerned about the stress Marinol was having on my liver, something smoked Cannabis does not do. He laments the MD/pharmaceutical symbiosis and looks foward to “the role of Cannabis in the relief of symptoms in our culture, medically and otherwise”. I point out to my probation officer that he took an oath, his hand on the Bible, to uphold the rights of the Citizens under the Constitution, “first and foremost”. Steve calls for common sense and empathy with families when compassion conflicts with the law.
